Provides that “an unauthorized alien who is 18 years of age or older and who knowingly enters or attempts to enter this state after entering the United States by eluding or avoiding examination or inspection by immigration officers” commits a first degree misdemeanor with a minimum sentence of 9 months in jail. Imposes the death penalty for capital offenses committed by “unauthorized aliens.” Requires a court to sentence a defendant adjudicated guilty of a capital felony who is an “unauthorized alien” to the death penalty.
