Doe v. Holder

Our office, in conjunction with the ACLU Immigrants’ Rights’ Project, filed a habeas corpus petition on behalf of two Sri Lankan men who were illegally smuggled into the country and sought political asylum.  They had been imprisoned in the U.S. for over three years without any determination as to whether they presented a risk of danger or flight sufficient to justify their extended detention.  The men sought their immediate release from detention or, alternatively, a bond hearing before the federal court, an Immigration Judge, or another neutral decision-maker with authority to grant their release.  However, before a hearing could even be held on their habeas petition, the men were deported back to Sri Lanka after a news article profiled their stories.
