Doe v. Snyder

We filed an emergency motion for a temporary restraining order to allow an inmate in Martin County Jail to obtain an abortion.  The plaintiff discovered she was pregnant prior to her sentencing and made repeated requests to the sentencing judge and jail officials that she be granted a medical furlough to obtain the procedure.  However, the sentencing court denied her requests and, given the length of her sentence, the plaintiff’s ability to terminate her pregnancy was running out.

The federal court granted the TRO and the plaintiff was able to get an abortion.  The parties reached a settlement under which the jail changed its policy to allow inmates to leave the jail in order to obtain an abortion without needing to get a court-ordered furlough first.
